Terms of Service

By creating an account or using CatchaCRM (the "Service"), you ("Customer", "you") agree to these Terms of Service ("Terms") and our Privacy Policy. For customers in Australia, the Australian terms below apply and prices are in Australian dollars (AUD).
1. The Service — what's included
CatchaCRM is a cloud-based, multi-tenant business platform. A subscription includes access to the following modules, subject to your plan tier:

Modules can be toggled on or off per workspace. Industry blueprints (25 available) pre-configure pipelines, fields and catalogs and may be swapped or stacked at any time. Features evolve continuously; we may add, improve or retire individual capabilities, and material removals will be notified in advance where practicable.
2. Accounts & eligibility
You must be at least 18, use the Service for business purposes, and provide accurate account details. You are responsible for your users' actions, for keeping credentials secure, and for assigning appropriate role scopes (admin / manager / worker) to your team.
3. Trials, plans & billing
- Trial. New workspaces receive a 21-day free trial. No card is required to explore; a payment method is required to continue after the trial.
- Plans. Launch (3 users), Grow (8), Pro (16) and Scale (28, plus additional users at a per-user monthly rate) — each a flat price with the stated users included.
- Currency & tax (AU). Prices are in AUD. Where GST applies, it will be shown at checkout; tax invoices are provided for every payment.
- Annual billing provides two months free versus monthly. Plan changes take effect immediately with pro-rated adjustment on the next invoice.
- Cancellation. Cancel anytime; access continues to the end of the paid period. Except where required by law, fees are non-refundable.
- Usage-based services. SMS, voice calling and telephony usage may incur metered charges at the rates shown in your workspace billing settings.
4. Your data
You own all data you and your users store in the Service — including contacts, leads, deals, quotes, invoices, jobs, photos, signatures, messages and files ("Customer Data"). You grant us a limited licence to host and process Customer Data solely to operate, secure and support the Service. You can export Customer Data (CSV and PDF where applicable) at any time, and for a reasonable period after termination.
5. Your responsibilities for your customers' data
You are the controller of the personal information you store about your own customers. You warrant that you have the right to store it and, where you use the Marketing or Comms Hub modules, that you have any consents required for electronic messaging: under the Spam Act 2003 (Cth) and Do Not Call Register Act 2006 (Cth) in Australia. SMS and email campaigns must include any legally required identification and opt-out mechanisms.
6. Third-party services
Some features rely on third parties: Stripe and PayPal (payments and hosted invoices), banking data you import, SMS and voice carriers, email delivery providers, Google AI models (AI Tools), and n8n (automation). Your use of those features is also subject to the relevant third party's terms. If you connect your own Stripe/PayPal account to invoice your customers, those transactions are between you, your customer and the payment provider — CatchaCRM is not a party to them and is not a payment processor, financial adviser or tax agent.
7. AI features
AI Tools generate draft content (copy, emails, SMS). Output may be inaccurate or incomplete — you must review it before sending or relying on it. You are responsible for content you send. AI features may process the prompt text you provide through third-party AI providers; do not include data you are not permitted to share.
8. Acceptable use
You must not: send spam or unlawful messages; store or distribute unlawful content; attempt to breach tenant isolation or probe the platform's security; resell access without authorisation; use the Service to build a competing product; or interfere with its operation. We may suspend accounts for serious or repeated breaches, with notice where practicable.
9. Intellectual property & white-label
We own the Service, its software and branding. Scale-plan white-labelling licenses you to present your own logo and product name within your workspace; it does not transfer any ownership of the underlying platform.
10. Availability & support
We target high availability but do not guarantee uninterrupted service. Planned maintenance will be scheduled to minimise disruption where practicable. Support is provided per plan (email or priority support). An in-app crash reporter files platform issues automatically.
11. Consumer guarantees, liability & law (Australia)
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (ACL) or other law that cannot lawfully be excluded. To the extent permitted by law, and subject to the ACL: (a) the Service is otherwise provided "as is"; (b) our aggregate liability arising out of or in connection with the Service is limited to the amount you paid for the Service in the 12 months preceding the claim; and (c) neither party is liable for indirect or consequential loss. Where a guarantee applies and liability may lawfully be limited, our liability is limited to re-supplying the Service or paying the cost of re-supply.
These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
12. Termination
Either party may terminate for material breach not cured within 14 days of notice. On termination we will make Customer Data available for export for at least 30 days, after which it is deleted from production systems in the ordinary course.
13. Changes & contact
We may update these Terms; material changes will be notified in-app or by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance. Questions: hello@catchacrm.com.
